J. Fink, et. al. v. Altare Publishing Inc. et. al., Santa Clara County Case No. 113CV249360 (Complaint filed July 11, 2013) Alleges violations of Cal. Bus. & Prof. Code § 17529.5 & Cal. Civ.Code § 1572. Removed to Federal Court on August 12, 2013. Remanded back to Sate Court on February 3, 2014.

Lawson v. Chabrowski, San Mateo County Case No. CIV518546 (Complaint filed December 19, 2012) Alleges civil harassment. Jury trial date set for August 25, 2014.

Successes

Chabrowski v. Lawson, Santa Clara County Case No. 112CH004656 (Complaint filed December 13, 2012). Alleges civil harassment. One of multiple lawsuits filed by Chabrowski, a vexatious litigant, against our client Lawson. Dismissed by Order of the Court on June 25, 2013.

Ken Green v. Excellent Hosting For You, LLC, Santa Clara County Case No. 112CV22975 (Complaint filed August 3, 2012). Alleges violations of Cal. Bus. & Prof. Code § 17529.5. Judgment in favor of Plaintiff granted after Default on October 18, 2013.

Hayostek v. LD Products, Inc., Santa Mateo County Case No. CIV506062 (Complaint filed June 1, 2011). Alleges violations of Cal. Bus. & Prof. Code § 17529.5. LD Products, Inc. Dismissed July 31, 2012; 2nd Amended Complaint filed on October 4, 2012 to rename DOE Defendant Class B Media LLC. Judgment in favor of Plaintiff granted after Default on November 30, 2012.

Hayostek v. Expressions Media, Santa Clara County Case No. 111CV193662 (Complaint filed February 4, 2011). Alleges violations of Cal. Bus. & Prof. Code § 17529.5. Judgment in favor of Plaintiff granted after Default on September 27, 2011.

Balsam v. Trancos, Inc., et. al., California Court of Appeals, First Appellate District Case Nos. A128485, A129458 (Complaint filed April, 2008). Alleges violations of Cal. Bus. & Prof. Code § 17529.5 & Civ. Code § 1750. A California appellate court upheld a lower court's ruling which found that a spammer violated Cal. Bus. & Prof. Code § 17529.5.

Balsam v. DSG, Inc., California Court of Appeals, First Appellate District Case No. A126680 (Complaint filed March 26, 2005.) Alleges violations of Cal. Bus. & Prof. Code § 17529.5 & Civ. Code § 1750. A California appellate court ruled, in an unpublished opinion, that spammers cannot simply dissolve a judgment debtor and then reincorporate under a new name using all the same web sites and the same business model.

Walton v. Mueller, California Court of Appeals, Sixth Appellate District Case No.H034058 (Complaint filed December 28, 2004.) Alleges violations of Cal. Bus. & Prof. Code § 17529.5 & Civ. Code § 1750. A California appellate court ruled that a spammer could not avoid payment on a judgment.

Ferguson v. Friendfinders, Inc., California Court of Appeals, First Appellate District Case No. A092653 (Complaint filed October 20, 1999.) Alleges violations of Cal. Bus. & Prof. Code § 17538.4. A California appellate court ruled that states have the legal right to regulate commercial email.
